# Terms of service

These terms govern the use of 1up-servers.com and of the game servers created through it. They are accepted upon creating an account. If you contract as a business, the annex for businesses at the end also applies.

Version of 30 October 2026

## 1. Service provider

The service is provided by Xabier Martínez Parada, a sole trader (autónomo) with tax ID (NIF) 72502232E, trading under the name 1up-servers, with address at Calle Jaizkibel 10, escalera izquierda, 3.º B, 20110 Pasaia (Gipuzkoa), España. For any matter relating to these terms, you may contact us by email at support@1up-servers.com or by post at that address.

## 2. Scope of the service

We host dedicated game servers for the games listed below, with a control panel, console, file manager, backups according to the plan contracted and network protection. The servers operate in our London (United Kingdom) and Paris (France) regions.

We do not sell or distribute the games. You must hold your own licence for each game that requires one and comply with the licence and server rules of each game (section 11).

## 3. Games available

The list of games is taken from our live catalogue. Games marked as beta may have limitations or be modified without prior notice. Games whose licence terms are under legal review remain in beta and may be withdrawn if their publisher does not authorise commercial hosting.

## 4. Eligibility requirements

You must be at least 16 years old to create an account. Each account belongs to a single person and may not be assigned, shared or sold. If we become aware that an account belongs to a person under 16, we close it as described on the minors page.

## 5. Your account

You are responsible for the activity of your account and for the safekeeping of your credentials; we recommend enabling two-step verification. Notify us at support@1up-servers.com of any suspected unauthorised access as soon as you become aware of it. We may require you to verify your email or your identity where there are indications of fraud.

## 6. Plans, quotas, add-ons and pause

The Free plan is subject to the hour, player and memory limits published on the pricing page, and its servers stop when no players are connected. Paid plans operate continuously within the resources of the plan. Add-ons extend a plan and are contracted separately. A paid plan may be paused as described on the billing page. The limits published at the time of contracting form part of these terms. The Free, Casual and Starter plans may display ads in the panel, only if you accept advertising cookies; the Pro plan and higher plans do not display ads.

## 7. Prices, payment, automatic renewal and invoices

Prices are displayed before payment, including the applicable VAT or sales tax. Plans and add-ons are charged in advance through Stripe for the selected period and renew automatically at the end of each period, at the price then in force, until you cancel them. Before payment, we show you the total amount, the period, the renewal date and price, and the cancellation procedure. We notify you by email in advance of any price change or of the end of a promotion, and you may cancel before the new price applies. Prices are set in euros. If you pay in another currency, the amount is derived from the euro price at the European Central Bank reference rate and remains fixed for your subscription until the euro price changes. If a charge is not completed, we retry it and notify you by email. If non-payment persists, we suspend the servers of the plan, preserving the world, and notify you of the date on which they will be deleted; if that date arrives without payment having been made, they are deleted and the account moves to the Free plan. Each invoice is sent to you as a PDF by email and remains available in the Billing section of the panel. By subscribing, you agree to receive invoices in electronic form; if you prefer one on paper, you may request it from support. If you receive a simplified invoice, you may request from Billing, within four years of its date, a full invoice with your details that replaces it.

## 8. Right of withdrawal

If you are a consumer, you may withdraw from each contract (a plan or an add-on) within 14 days of its conclusion, without giving any reason, as described on the refunds and withdrawal page. Since the service begins immediately at your express request, if you withdraw we refund the amount paid less the proportional part of the service provided up to the date of withdrawal, calculated on the basis of the days used. The right of withdrawal expires once the service has been fully provided.

This right is independent of our voluntary 3-day money-back guarantee, described on the same page.

## 9. Cancellation

You may cancel online at any time from Billing, through a simple procedure that does not require a call or a chat. Cancellation takes effect at the end of the paid period; until then, the server remains in operation. Thereafter, your data are retained or archived in accordance with the privacy policy.

Switching provider and retrieval of your data. You may ask us at any time, from Support or at support@1up-servers.com, to transfer to another provider or to your own infrastructure, without any notice period. From your request, a transition period of no more than 30 calendar days begins, during which the contract remains in force, the service continues to operate, we assist you with the migration, we inform you of any known risk to continuity and we maintain the security of the data. You may export all your exportable data: all files of each server (the world, configuration, mods, plugins and logs it contains), your backups and your account data (export in JSON format), in open formats. The only data excluded are the internal data of our platform that do not originate from you, such as the orchestration and network configuration. Once the transition has ended, you have at least 30 additional calendar days to download them; after that period, we delete them completely, copies included. We confirm the termination of the contract to you by email when the switch is completed or, if you only wish to have your data deleted, when you request it. Switching provider entails no cost. Your data are processed in France and in the United Kingdom (OVHcloud), under the jurisdiction of those countries, and are handed over to an authority only when a rule of the European Union or of a Member State so requires.

## 10. Conformity and availability

We provide the service as described in these terms and on the pricing page, in accordance with consumer legislation on digital services. We work to keep the platform available, although we cannot guarantee uninterrupted operation; planned maintenance is announced on the status indicator and urgent maintenance is carried out when security so requires. If the service is not in conformity, you may require it to be brought into conformity and, failing that, a price reduction or termination of the contract. As this is a digital service supplied continuously, we are liable for its conformity throughout the term of the contract.

## 11. Your content and game licences

The worlds, settings and files you upload remain your property. You grant us only the authorisation necessary to host, copy, back up and restore them for your benefit. You must comply with the acceptable use policy and the licence of each game: in Minecraft only paid accounts may play, so servers using unauthorised copies or running in offline mode are not permitted; for games whose publisher restricts commercial hosting, you must hold the authorisation that publisher requires; in Counter-Strike 2, you must provide your own Steam game server token.

## 12. Moderation and complaints

We act on reports received through the report form and on signals from the automated tools that monitor resource usage, network attacks and known malware. Every measure taken (removal of content, restriction of a server, suspension of an account) is accompanied by a statement of reasons setting out the facts, the rule applied and whether automated means were used. You may appeal within 6 months by replying to that communication; the appeal is reviewed by a person other than the one who took the decision. You may also refer the matter to any out-of-court dispute settlement body certified under the Digital Services Act, or to the courts.

## 13. Liability

We are liable, in accordance with the law, for damage caused by our breach of these terms. If you are a consumer, nothing in these terms limits the rights granted to you by consumer legislation. We are not liable for loss of data that you could reasonably have avoided by downloading your backups, nor for content uploaded by you or your players.

## 14. Amendments to the terms and the service

We may amend these terms or the features of the service only for a valid reason: a change in the law or a decision of an authority, a change in the games, in their software or in the providers we use, security, the prevention of abuse or other relevant operational reasons. Each document displays its own version date. Where an amendment to the terms is substantial, we inform you in writing at least 30 days before it applies and ask you to accept the new terms; if you do not agree, you may cancel at no cost before they enter into force.

If a change to the service affects your access to or use of it in a manner that is more than minor, for example because it withdraws a feature available to you or displays ads on a plan contracted without them, we notify you by email reasonably in advance, stating what changes and when. You may terminate the contract at no cost within 30 days of the notification or of the change, whichever is later, and we refund the unused part of the paid period. The foregoing does not apply if we allow you to keep the service without the change and at no additional cost.

## 15. Governing law and dispute resolution

These terms are governed by Spanish law. If you are a consumer, you retain the protection of the mandatory rules of your country of residence and may bring proceedings before the courts of your domicile.

You may submit any complaint or claim from Support in your panel, by email at support@1up-servers.com or by post addressed to Xabier Martínez Parada, Calle Jaizkibel 10, escalera izquierda, 3.º B, 20110 Pasaia (Gipuzkoa), España. We provide you with a reference number and respond within a maximum of 15 days.

If you are not satisfied with the response, you may contact the consumer authority of your place of residence or an alternative dispute resolution entity for consumer disputes, such as the Basque Consumer Arbitration Board (Kontsumobide, kontsumobide.euskadi.eus) or that of your autonomous community or country. We do not adhere to the Spanish Consumer Arbitration System; if you propose arbitration to us, we will inform you in each case whether we will participate. The European online dispute resolution platform ceased operating in July 2025 and is no longer available.

## 16. Annex for businesses

If you contract as a business: the right of withdrawal does not apply; on the website, every customer in the European Union is invoiced as a consumer, with VAT; a business in the European Union with a VAT number valid in VIES that needs a reverse-charge invoice may subscribe by writing to support (support@1up-servers.com), and that invoice is issued separately with the mention «Inversión del sujeto pasivo» (reverse charge) and our intra-community VAT number ES72502232E; the Data Processing Agreement applies to the player data we process on your behalf; and the liability of each party is limited to the amount paid in the preceding 12 months, except in cases of wilful misconduct, gross negligence or where the law does not permit such a limitation.
